Relief allows Congress leader to seek anticipatory bail from appropriate court; case stems from allegations against Assam CM’s wife

Hyderabad/Guwahati, April 10: The Telangana High Court on Friday granted Congress leader Pawan Khera a seven-day transit anticipatory bail in connection with a defamation case registered by Assam Police. The interim relief allows Khera to approach the appropriate court for regular anticipatory bail within the stipulated period.
The order was passed by Justice Sujana Kalasikam, who directed Khera to cooperate with the investigation and comply with standard conditions attached to such relief.
Court Grants Interim Protection
Transit anticipatory bail is a temporary legal protection that enables an आरोपी to avoid arrest while moving between jurisdictions to seek regular bail. In this case, the Telangana High Court’s order provides Khera time to approach the relevant court in Assam or another competent jurisdiction.
Khera was reportedly in Hyderabad at the time he learned of the FIR, which prompted him to seek urgent relief from the High Court.
Defence and Prosecution Arguments
Senior advocate Abhishek Manu Singhvi, appearing for Khera, argued that the case was politically motivated and that the allegations, even if disputed, should fall under civil defamation rather than criminal provisions requiring custodial action.
The FIR includes provisions under the Bharatiya Nyaya Sanhita related to false statements, cheating, and criminal conspiracy.
On the other hand, Assam Advocate General Devajit Saikia questioned the jurisdiction of the Telangana High Court, noting that Khera is a resident of Delhi and suggesting that he should have sought relief there.
Background of the Case
The case originates from statements made by Khera at a press conference on April 5, where he alleged that Riniki Bhuyan Sarma, wife of Assam Chief Minister Himanta Biswa Sarma, held multiple foreign passports and had undisclosed overseas assets.
These claims were denied by Sarma and his wife, following which a complaint was filed and an FIR registered in Assam.
Earlier, Assam Police had visited Khera’s residence in Delhi as part of the investigation but did not find him present.
Political Reactions
Chief Minister Himanta Biswa Sarma has defended the police action, stating that law enforcement agencies are obligated to act on FIRs and pursue those named in investigations.
He also criticised the Congress, accusing it of making unverified allegations. The Congress, meanwhile, has described the case as politically motivated and an attempt to target opposition leaders.
Context and Legal Significance
Transit anticipatory bail is often sought when a case is registered in a different state from where the accused is located. It ensures that individuals can seek legal remedies without immediate risk of arrest, especially in cases involving multiple jurisdictions.
The case has drawn attention due to the involvement of senior political figures and the timing around electoral developments.
Public Impact
The matter highlights the intersection of political speech, defamation law, and criminal provisions. It also raises questions about the use of legal mechanisms during politically sensitive periods.
For the public, the case underscores the importance of due process and the role of courts in balancing investigative powers with individual rights.
Conclusion
With interim protection in place for seven days, Pawan Khera is expected to approach the appropriate court for regular anticipatory bail. The case is likely to remain in focus as legal proceedings continue alongside ongoing political exchanges. (With inputs from H.S.)
